Delegates Sumner, Porter, Shott, Frazier, Crosier, Hall, Moore, Susman, Wooton, Moye, Canterbury, Campbell, Mahan and Phillips move to amend the bill on page 1, after line 24 by striking everything after the enacting clause and inserting in lieu thereof the following:
"That the items of the total appropriation from the State Road Fund, fund 9017, fiscal year 2009, organization 0803, be supplemented and amended to read as follows:

The above appropriations are to be expended in accordance with the provisions of chapters seventeen and seventeen-c of the Code of West Virginia.
The Commissioner of Highways shall have the authority to operate revolving funds within the State Road Fund for the operation and purchase of various types of equipment used directly and indirectly in the construction and maintenance of roads and for the purchase of inventories and materials and supplies.
There is hereby appropriated within the above items sufficient money for the payment of claims, accrued or arising during this budgetary period, to be paid in accordance with sections seventeen and eighteen, article two, chapter fourteen of the Code of West Virginia.
It is the intent of the Legislature to capture and match all federal funds available for expenditure on the Appalachian Highway System at the earliest possible time. Therefore, should amounts in excess of those appropriated be required for the purposes of Appalachian programs, funds in excess of the amount appropriated may be made available upon recommendation of the commissioner and approval of the Governor. Further, for the purpose of Appalachian programs, funds appropriated to line items may be transferred to other line items upon recommendation of the commissioner and approval of the Governor.
From the above appropriation to Interstate Construction (activity 278) $7,500,000 shall be used by the West Virginia Parkways, Economic Development and Tourism Authority for road maintenance and bridge repair.
The purpose of this supplemental appropriation bill is to supplement, amend, increase and add items of appropriation in the aforesaid account for the designated spending unit for expenditure during the fiscal year ending June 30, 2009."
